THOSE WHO WANTED TO STEAL THE FARMER'S MONEY WERE CAUGHT!

Since the early years of independence, targeted reforms have been carried out in our Republic, providing for the constant protection and support of entrepreneurship. State support for entrepreneurship contributes to the formation of genuine market relations and the development of competition, which ensures an increase in the quality of products and services.

Therefore, courts are also carrying out a number of measures to protect the rights and interests of business entities.

As an example, the Fergana Regional Council of Farmers filed a lawsuit in court in the interests of the "Abdulkhakimov Abdulhamid fayz" farm, demanding to recover from the limited liability company "B LT" the principal debt of 24,145,461 soums, a penalty of 12,072,730 soums, and postal expenses of 41,200 soums.

According to the case documents, futures contracts for the cultivation and purchase of raw cotton were concluded between the "Abdulkhakimov Abdulhamid fayz" farm ("Seller") and the limited liability company "BLT" ("Buyer") on October 1, 2021 (No. 1), December 30, 2022 (No. 21), and October 2, 2024 (No. 7159523).

According to clause 3.1 of the contract No. 7159523 dated October 2, 2024, concluded between the parties, the "Seller" shall deliver the product in September-November of the financial year.

According to clause 3.2 of the contract, the "Buyer" shall transfer 80 percent of the contract payment funds to the seller's account 23210 no later than three working days from the date of acceptance of the product, and the remaining part by December 31 of the financial year, based on Resolution No. 680 of the Cabinet of Ministers of the Republic of Uzbekistan dated December 25, 2023.

According to Article 55 of the Constitution of the Republic of Uzbekistan, everyone has the right to protect their rights and freedoms by all means not prohibited by law.

Everyone is guaranteed the right to have their violated rights and freedoms restored by a competent, independent, and impartial court within the time limits established by law.

According to Article 236 of the Civil Code of the Republic of Uzbekistan, obligations must be duly performed in accordance with the terms of the obligation and the requirements of the law, and in the absence of such terms and requirements, in accordance with the customs of business turnover or other generally accepted requirements.

According to the first part of Article 238 of the Civil Code, the obligation must be performed in a manner agreed upon and acceptable to the parties.

According to the first part of Article 357 of the Civil Procedure Code, the contract enters into force from the moment of its conclusion and becomes binding on the parties.

Therefore, from the defendant limited liability company "BLT", 21,400,743.04 soums of principal debt, 5,200,000 soums of penalty, and 41,200 soums of postal expenses, totaling 26,641,943.04 soums, were recovered in favor of the plaintiff "Abdulkhakimov Abdulhamid fayz" farm.

Similarly, 10,265,641 soums of unjustly withheld funds and 37,500 soums of postal expenses, totaling 10,303,141 soums, were recovered from the defendant limited liability company "BLT" in favor of the plaintiff "Avazbek Kirgizov" farm.

Therefore, ensuring the protection of the legal rights and interests of business entities, eliminating and preventing identified violations of the law, as well as taking appropriate measures against officials who have committed identified violations of the law, and ensuring the rule of law are among the important tasks set by the courts.
